These Terms of Service (“Terms”) govern your access to and use of the True Booker platform (“Service”) operated by True Booker (“we,” “us,” or “our”). By using the Service, you (“Client,” “you,” or “your”) agree to these Terms.
1. Description of Services
True Booker provides a cloud-based business automation platform that may include:
- AI-powered phone answering and call handling
- SMS-based customer communication and booking
- Appointment scheduling integrations
- Call tracking, transcripts, and analytics
- Business workflow automation and integrations
Certain features rely on third-party providers, including but not limited to telephony carriers, AI providers, and automation platforms.
We reserve the right to modify, add, or discontinue features at any time.
2. Account Registration & Onboarding
To use the Service, you must:
- Provide accurate business and contact information
- Complete onboarding steps (including AI setup, number provisioning, and integrations where applicable)
- Maintain updated account information
You acknowledge that:
- Some features (e.g., AI assistant, phone number activation) require full onboarding completion
- Failure to complete onboarding may limit functionality
- You are responsible for ensuring your configuration is correct
3. Client Responsibilities & Acceptable Use
You agree to:
- Use the Service only for lawful business purposes
- Ensure all information provided is accurate and not misleading
- Not use the Service for spam, harassment, fraud, or illegal activities
- Not attempt to reverse-engineer, disrupt, or misuse the platform
You are solely responsible for:
- Your communications with customers
- The content sent via SMS, voice, or AI interactions
- Compliance with all applicable laws and regulations
4. Messaging, Calling & Compliance
You acknowledge and agree that:
- You are solely responsible for compliance with all messaging and calling laws, including but not limited to:
- Telephone Consumer Protection Act (TCPA)
- CTIA guidelines
- A2P 10DLC registration requirements
- You must obtain all required customer consents before:
- Sending SMS messages
- Placing automated or AI-assisted calls
- You must clearly identify your business in communications
True Booker:
- Does not guarantee message delivery or call completion
- May suspend or terminate services for suspected non-compliance
- May rely on third-party carrier decisions, which are outside our control
5. AI Assistant Disclaimer
You acknowledge that:
- AI-generated responses may not always be accurate, complete, or appropriate
- The AI assistant operates based on configurations and data you provide
- You are responsible for reviewing and configuring AI behavior
True Booker is not responsible for:
- Miscommunications by AI
- Missed bookings or incorrect responses
- Business losses resulting from AI interactions
6. Third-Party Services
The Service integrates with third-party providers, including:
- Telephony providers
- AI systems
- Scheduling platforms
You acknowledge that:
- These providers operate under their own terms and policies
- Service performance depends on these third parties
- True Booker is not liable for outages, errors, or actions of third-party providers
7. Fees, Billing & Subscriptions
- Fees are based on your selected subscription plan and applicable usage (e.g., SMS, minutes)
- Billing occurs on a recurring monthly or annual basis
- All fees are non-refundable unless otherwise stated
Failure to pay may result in:
- Suspension or termination of services
- Loss of access to phone numbers, AI assistants, or data
8. Data Ownership & Privacy
- You retain ownership of all customer and business data (“Customer Data”)
- You grant True Booker a limited license to process Customer Data solely to provide the Service
We do not:
- Sell your Customer Data
- Use your Customer Data for our own marketing purposes
You are responsible for:
- Lawful collection and use of Customer Data
- Providing required privacy notices to your customers
9. Call Recordings & Transcripts
If enabled:
- Calls may be recorded and transcribed
- You are responsible for complying with applicable recording laws
True Booker is not responsible for unlawful recording practices by Clients.
10. Intellectual Property
- True Booker retains all rights to the platform, software, and related technology
- You retain ownership of your branding, content, and customer data
You may not:
- Copy, modify, or resell the Service without authorization
11. Service Availability & Limitations
The Service is provided “as is” and “as available.”
We do not guarantee:
- Continuous uptime
- Error-free performance
- Compatibility with all systems
We are not responsible for:
- Carrier delays or filtering
- Network outages
- Integration failures
12. Limitation of Liability
To the maximum extent permitted by law:
- True Booker shall not be liable for indirect, incidental, or consequential damages
- This includes lost revenue, missed bookings, or reputational harm
Our total liability is limited to the amount paid by you in the three (3) months preceding the claim.
13. Indemnification
You agree to indemnify and hold harmless True Booker from any claims arising out of:
- Your use of the Service
- Your communications with customers
- Your violation of laws or regulations
14. Termination
You may cancel your account at any time.
We may suspend or terminate your access if:
- You violate these Terms
- You fail to pay fees
- Your use creates legal or operational risk
Upon termination:
- Access to services may be immediately revoked
- Phone numbers and integrations may be released or deactivated
15. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
16. Changes to Terms
We may update these Terms from time to time. Continued use of the Service constitutes acceptance of the updated Terms.
